Data protection for business partners or their employees
The protection of your personal data and compliance with all data protection regulations (in particular the EU General Data Protection Regulation - GDPR, the Austrian Data Protection Act - DSG - and the Austrian Telecommunications Act - TKG) is of particular concern to us.
In this data protection information, we inform you how we process your personal data (e.g. names and contact details) in the context of our (potential) business relationship and what claims and rights you are entitled to under data protection regulations. We would like to point out that this involves data processing that is essential in the context of our (potential) business relationship. This data protection information may be supplemented by additional data protection declarations, conditions or notices that are provided to you.

2. processing of personal data, purposes and legal bases
As part of our business relationship, we may process personal data such as
- Business contact information such as name, title, contact person, function, company affiliation, professional contact details (business address, telephone number, cell phone number, fax number).
- Individual information such as role, information from publicly available sources (e.g. company register), customer number.
- Financial data for processing payment transactions (e.g. account number, VAT number, dunning data and blocking codes; turnover).
- Information that is necessary for the initiation, processing and administration of business relationships or that you provide voluntarily (e.g. information on our offers, orders, order confirmations, delivery bills, invoices, contracts, etc.).
- Visitor data such as date, place, name and our visited employees.
You have usually provided us with this data yourself, but it is also possible that it originates from the company for which you work (e.g. your colleagues or superiors), from public sources (e.g. company register), or from other third parties who may lawfully transmit personal data to us (e.g. other group companies), or that this data was generated by our IT systems (e.g. customer number).
We would like to point out that we naturally do not process all the data listed above in every case, but that the specific data processed by us depends on the individual case.
Nature and purposes of processing
Your personal data is processed for the following purposes as part of our business relationship:
- Communication and customer support (e.g. for processing inquiries);
- Business initiation, processing and administration as well as maintenance of business relationships (e.g. for processing orders and commissions, customer administration and support, accounting, etc.);
- Maintaining and protecting the security of our products and services or building and plant security (e.g. access control system);
- Ensuring IT security and IT operations;
- Visitor management (for the organization of external visits including guest support, creation of visitor passes, WLAN access, hospitality);
- Event and seminar organization;
- Compliance with legal requirements (e.g. retention obligations under tax and commercial law);
- Direct advertising regarding our products or services, unless you have objected to this;
- Settlement of insurance claims;
- Data protection management;
- Legal advice and settlement of legal disputes, enforcement of existing contracts and for the examination, assertion, exercise and defense of legal claims.
The processing is necessary to achieve the above-mentioned purposes. If you do not provide us with certain data, this may mean that we cannot conclude the contract with you, cannot provide the requested service, cannot take the requested pre-contractual measures or cannot fulfill the stated purposes in accordance with the contract or the law. We would like to point out that not all of the processing activities listed above must always apply to you, but that this depends on your respective activity and relationship with us. The examples given for the individual purposes are not exhaustive.
Legal basis
We process your personal data on the basis of the implementation of pre-contractual measures or for the fulfillment of the contract in accordance with Art. 6 para. 1 lit. b GDPR or to protect our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. As a rule, our legitimate interests lie in ensuring smooth business processes and secure business operations. Furthermore, it may be necessary for us to process your personal data due to legal obligations (e.g. due to tax regulations) in accordance with Art. 6 para. 1 lit. c GDPR. Only in exceptional cases, if none of the other legal bases listed come into question, do we process your personal data on the basis of your consent in accordance with Art. 6 para. 1 lit. a GDPR.
3. do we pass on your data?
We may only transfer personal data to other departments or companies of the starlim//sterner Group(https://www.starlim-sterner.com/kontakt/standorte/) or to third parties such as legal advisors, tax advisors, auditors or other business partners (e.g. logistics partners for the execution and processing of deliveries) to the extent necessary and permissible for the above-mentioned purposes.
Furthermore, your personal data may also be processed on our behalf by our service providers (processors). These processors are contractually obliged to comply with data protection regulations.
Otherwise, unless expressly stated otherwise in this data protection information, we will not pass on your personal data to third parties unless this is necessary for the assertion, exercise or defense of legal claims or for the fulfillment of our obligations or is required by law/authorities. Possible recipients in this case may be legal representatives, competent authorities, offices and courts.
If the recipients listed above are located in countries outside the European Union (in so-called "third countries"), data protection regulations may apply there that do not guarantee the same level of data protection as in your country of residence. A transfer will therefore only take place in accordance with the legal requirements if an adequacy decision has been issued by the European Commission for the third country, appropriate guarantees have been agreed with the recipient (e.g. EU standard contractual clauses have been concluded), the recipient participates in an approved certification system, binding internal data protection regulations pursuant to Art 47 GDPR exist or an exception pursuant to Art 49 GDPR exists (e.g. because the transfer is necessary for the performance of a contract concluded between you and us or you have expressly consented to the transfer).
4. how long will your data be stored?
As soon as we no longer need your personal data for the purposes described above, it will be deleted, provided that there are no statutory retention obligations or other (legally justified) reasons that make continued retention of your data necessary.

As a data subject, you have the following rights:
- You can request information about the processing of your data (Art. 15 GDPR);
- You can request the correction of incorrect data (Art. 16 GDPR);
- If necessary, you can request the deletion of your data (Art. 17 GDPR);
- If necessary, you can request the restriction of the processing of your data (Art. 18 GDPR);
- If necessary, you can object to the processing if there are reasons for this arising from your particular situation (Art. 21 GDPR);
- If necessary, you can request the transfer of your data in a common format if you have provided us with this data (Art. 20 GDPR);
- If the processing is based on your consent, you have the right to withdraw your consent at any time, irrespective of any further consent. The withdrawal of consent does not affect the legality of the data processed on the basis of the consent until the withdrawal.
- You can lodge a complaint with the supervisory authority.
